Major Win for Fubara: ECOWAS Case May Restore Six Lost Months of Tenure

Attached to this email is an application submitted to the ECOWAS Court of Justice to deliver a default judgment against the Federal Government of Nigeria.

The summary is that the ECOWAS Court of Justice was asked to declare that the State of Emergency in Rivers State and appointment of a Sole Administrator was a violation of ECOWAS Treaty of 2001. The said ECOWAS Treaty states that no government should use non-elected officials to administer any national or sub-national units of ECOWAS member states.

This application commenced sometime ago in April 2025. in a lawsuit filed by the Association of Legislative Drafting and Advocacy Practitioners-ALDRAP and Dr. Tonye Clinton Jaja as plaintiffs.

The Federal Government of Nigeria failed to file any response within the stipulated time. Therefore, they have foreclosed their chances.

The positive implications is that it opens the way for Governor Fubara to enjoy an additional six months period which was lost to the illegal suspension of himself, his Deputy Governor and the Rivers State House of Assembly.

The lawyer that handles this case was my PhD classmate at the University of London and he specialises in both International and ECOWAS law.

This is a landmark judgment and shows the benefits of persistence and being our brother’s keeper as IJAWS.

I did not ask for or receive one naira from anyone to prosecute this lawsuit.

This judgment is coming at the best of times now that the government of the United States of America is alleging that the government of Nigeria is not taking sufficient steps to tackle insecurity in Nigeria.

This judgment provides evidence.

Instead of the President and the National Assembly of Nigeria to proclaim a State of Emergency in Kebbi State wherein there are real and ongoing acts of terrorism. They proclaimed a State of Emergency in Rivers State (March to September 2025) based on a PHANTOM allegation of threats to blow up oil pipelines.
