Court Rules On Suit Seeking To Remove David Mark, Aregbesola As ADC National Leaders

Federal High Court in Abuja has ruled on suit seeking to remove the national chairman of African Democratic Congress (ADC), David Mark as well as the party’s national secretary, Rauf Aregbesola.

The presiding judge, Justice Joyce Abdulmalik on Friday, threw out the suit for lack of merit, citing that the suit bordered on internal party affair which is not justiceable by a court; hence, no court has jurisdiction over such matter.

Justice Joyce Abdulmalik held that leadership and membership of a political party is voluntary, noting that a political party is a voluntary organization where no one is compelled to join.

The judge advised the aggrieved members of ADC seeking the removal of the party’s current leadership to resort to internal party mechanism as means to addressing their their concerns or quit their membership to the party and join another political party.

She emphasized that no court can exercise jurisdiction over a case bordering on party’s membership and leadership.
